Il comporte de mani\u00e8re claire et lisible, dans l&rsquo;ordre pr\u00e9cis\u00e9 ci-dessous (. . .) \u00bb.\u00a0<\/em>Mais que signifie l\u2019expression \u00ab\u00a0corps huit\u00a0\u00bb\u00a0? Le banquier soutenait que son contrat correspondait \u00e0 huit points Pica, norme utilis\u00e9e par la typographie informatique. Mais ce point Pica correspond \u00e0 0,94 du point Didot, norme cr\u00e9\u00e9e en 1785 par Fran\u00e7ois-Ambroise Didot et traditionnellement utilis\u00e9e en imprimerie.<\/p><p>La Cour juge\u00a0: \u00ab\u00a0<em>le corps 8 correspond \u00e0 3 mm en points Didot. S&rsquo;il est exact qu&rsquo;aucune disposition l\u00e9gale ou r\u00e9glementaire ne d\u00e9finit pr\u00e9cis\u00e9ment le corps 8 ou n&rsquo;exclut le point PICA, pour autant, lorsque le l\u00e9gislateur fran\u00e7ais a l\u00e9gif\u00e9r\u00e9 le 24 mars 1978 dans le domaine du droit de la consommation, il est permis de consid\u00e9rer qu&rsquo;il s&rsquo;est r\u00e9f\u00e9r\u00e9 implicitement \u00e0 la norme typographique fran\u00e7aise et donc au point Didot. Il ne peut \u00eatre laiss\u00e9 aux seuls \u00e9tablissements bancaires le soin de d\u00e9terminer quel point et quelle police permettrait de consid\u00e9rer que l&rsquo;offre de pr\u00eat est suffisamment lisible alors qu&rsquo;il s&rsquo;agit d&rsquo;appliquer des textes d&rsquo;ordre public ayant trait \u00e0 la protection des consommateurs. Le corps huit correspond \u00e0 3 mm en points Didot. Le point de r\u00e9f\u00e9rence \u00e0 multiplier par 8 reste le point Didot (soit 0,375), d&rsquo;o\u00f9 une police de caract\u00e8res d&rsquo;au moins trois millim\u00e8tres (car : 0,375&#215;8 = 3 mm)<\/em>\u00a0\u00bb.<\/p><p>Les banques sont donc invit\u00e9es \u00e0 surveiller la taille des caract\u00e8res de leurs contrats, \u00e0 bannir le point Pica et \u00e0 adopter le point Didot\u2026 Si les caract\u00e8res sont trop petits, la sanction encourue est la d\u00e9ch\u00e9ance du droit aux int\u00e9r\u00eats.
